1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Khameran LLC (Help) ("Company," "we," "our," or "us"), a limited liability company. These Terms govern your access to and use of our mobile application, website, and related services (collectively, the "Platform").

2. Definitions

"Customer" refers to users who request and book services through the Platform
"Service Provider" or "Vendor" refers to independent contractors who offer services through the Platform
"Services" refers to the services offered by Service Providers through the Platform
"Platform" refers to our mobile application, website, and all related services
"User" refers to any person who accesses or uses the Platform, including both Customers and Service Providers

3. Eligibility

To use our Platform, you must:

Be at least 18 years of age (or the age of legal majority in your jurisdiction)
Have the legal capacity to enter into binding contracts
Not be prohibited from using the Platform under applicable laws
Provide accurate, current, and complete information during registration
Maintain and update your account information to keep it accurate and current

4. User Accounts

4.1 Account Registration

To access certain features of the Platform, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access or security breach
Accept responsibility for all activities that occur under your account
Not share your account with others or allow others to access your account

4.2 Account Termination

5. Platform Services

5.1 Nature of Services

Khameran LLC (Help) operates as a technology platform that connects Customers with independent Service Providers. We do not:

Employ Service Providers as employees or agents
Provide the services ourselves
Guarantee the quality, safety, or legality of services provided
Act as an employer, agent, or representative of Service Providers

5.2 Service Provider Relationship

Service Providers are independent contractors who:

Operate their own businesses
Set their own schedules and service offerings
Are responsible for their own taxes, insurance, and licenses
Determine how they perform services
Bear all risks associated with their business operations

6. Bookings and Payments

6.1 Service Bookings

Customers can browse available services and book appointments through the Platform
Booking confirmations are subject to Service Provider acceptance
Prices displayed are provided by Service Providers and may be subject to change
We reserve the right to refuse or cancel any booking at our discretion

6.2 Payment Processing

Payments are processed through secure third-party payment processors
You authorize us to charge your selected payment method for all fees
We are not responsible for errors made by third-party payment processors
Service Providers are responsible for reporting and paying all applicable taxes

6.3 Cancellations and Refunds

Cancellation policies are set by individual Service Providers
Cancellation fees may apply depending on timing and Service Provider policy
Refunds are processed according to the applicable cancellation policy
Disputed charges must be reported within 30 days of the transaction

7. User Conduct

You agree not to:

Violate any applicable laws, regulations, or third-party rights
Use the Platform for any fraudulent, illegal, or unauthorized purpose
Harass, abuse, threaten, or intimidate other users or Service Providers
Post or transmit any harmful, offensive, or inappropriate content
Attempt to gain unauthorized access to the Platform or other users' accounts
Interfere with or disrupt the Platform's operation or servers
Use automated systems (bots, scrapers) to access the Platform
Impersonate any person or entity or misrepresent your affiliation
Collect or harvest information about other users without consent
Circumvent any security features or access controls

8. Intellectual Property

8.1 Our Rights

The Platform and all content, features, and functionality are owned by Khameran LLC (Help) and are protected by copyright, trademark, and other intellectual property laws. This includes:

Software, code, and technology
Logos, trademarks, and brand elements
Text, graphics, images, and design elements
Compilations of content and data

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes, subject to these Terms.

8.3 User Content

By submitting content to the Platform (reviews, photos, messages), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating the Platform.

9. Disclaimers and Limitations of Liability

9.1 Service Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Accuracy, reliability, or availability of the Platform
Quality or safety of services provided by Service Providers
Uninterrupted or error-free operation of the Platform

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KHAMERAN LLC (HELP) SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Personal injury or property damage resulting from use of the Platform
Actions or omissions of Service Providers or other users
Any damages exceeding the amount you paid to us in the past 12 months

9.3 Third-Party Services

We are not responsible for:

The quality, safety, or legality of services provided by Service Providers
The accuracy of information provided by Service Providers
Disputes between Customers and Service Providers
Actions or failures to act by third-party payment processors

10. Indemnification

You agree to indemnify, defend, and hold harmless Khameran LLC (Help) and its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the Platform
Your violation of these Terms
Your violation of any rights of third parties
Any content you submit to the Platform
Your interactions with other users or Service Providers

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

11.2 Arbitration Agreement

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except for:

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

Posting updated Terms on the Platform
Updating the "Last Updated" date

Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms.

15. Service Provider Terms

15.1 Vendor Responsibilities

Service Providers using the Platform agree to:

Maintain all required licenses, permits, and insurance
Comply with all applicable laws and regulations
Provide services in a professional and timely manner
Maintain accurate service descriptions and pricing
Honor bookings and cancellation policies
Pay all applicable taxes and fees

15.2 Service Provider Fees

Service Providers agree to pay platform fees as specified in their Service Provider Agreement. Fees may include:

Commission on completed bookings
Subscription fees for premium features
Processing fees for payment transactions

16. Background Checks and Verification

While we may conduct background checks or verify credentials of Service Providers, we do not guarantee:

The accuracy or completeness of background check information
That Service Providers are qualified, licensed, or insured
The safety or quality of services provided

Customers should conduct their own due diligence before engaging Service Providers.

17. Insurance and Liability

Service Providers are responsible for maintaining appropriate insurance coverage. Khameran LLC (Help) does not provide insurance coverage for services performed through the Platform.

18. Termination

Either party may terminate their account at any time. Upon termination:

Your right to use the Platform immediately ceases
We may delete your account and all associated data
Certain provisions of these Terms survive termination (e.g., indemnification, limitation of liability)
Outstanding obligations remain in effect

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and Khameran LLC (Help) regarding use of the Platform.

21. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

22. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or government actions.
